Rural America: Legal and Interdisciplinary Research Guide

We often hear that there is no way out of the modern economic and political tensions that fall along geographic lines. The media regularly declares that rural America is dying and that rural voters are driven only by anger. This narrative of hopelessness centers on the role that markets have played in abandoning rural regions and populations. In Reviving Rural America, Ann M. Eisenberg analyzes our society's laws and policies' role in the urban/rural divide to make the case for hope. After chronicling such failures and those of liberal development strategies in the region, Stump explores true system change beyond law "reform." The story of Native peoples' resistance to environmental injustice and land incursions, and a call for environmentalists to learn from the Indigenous community's rich history of activism. Through the unique lens of "Indigenized environmental justice," Indigenous researcher and activist Dina Gilio-Whitaker explores the fraught history of treaty violations, struggles for food and water security, and protection of sacred sites, while highlighting the important leadership of Indigenous women in this centuries-long struggle. In Building a Resilient Twenty-First-Century Economy for Rural America, Don E. Albrecht visits rural communities that have traditionally been dependent on a variety of goods-producing industries, explores what has happened as employment in these industries has declined, and provides a path by which they can build a vibrant twenty-first-century economy. Bringing a personal understanding of the effects on rural communities and residents, Albrecht focuses each chapter on a community that has traditionally been economically dependent on a single industry--manufacturing, coal mining, agriculture, logging, oil and gas production, and tourism--and the consequences of losing that industry. He also lays out a plan for rebuilding America's rural areas and creating an economically vibrant country with a more sustainable future.   The rural economy cannot return to the past as it was structured and instead must look to a new future. Building a Resilient Twenty-First-Century Economy for Rural America describes the source of economic concerns in rural America and offers real ways to address them. Mississippi, the poorest state in the U.S. with the highest percentage of Black people, a history of vicious racial terror and concurrent Black resistance is the backdrop and context for the drama captured in this collection of essays Jackson Rising: The Struggle for Economic Democracy and Self-Determination in Jackson Mississippi. Undeterred by the uncertainty, anxiety and fear brought about by the steady deterioration of the neoliberal order over the last few years, the response from Black activists of Jackson, Mississippi has been to organize. Inspired by the rich history of struggle and resistance in Mississippi and committed to the vision of the Jackson-Kush Plan, these activists are building institutions rooted in community power that combine politics and economic development into an alternative model for change, while addressing real, immediate needs of the people. The experiences and analyses in this compelling collection reflect the creative power that is unleashed when political struggle is grounded by a worldview freed from the inherent contradictions and limitations of reform liberalism. As such, Jackson Rising is ultimately a story about a process that is organized and controlled by Black people who are openly declaring that their political project is committed to decolonization and socialism. And within those broad strategic and ethical objectives, Jackson Rising is also a project unapologetically committed to self-determination for people of African descent in Mississippi and the South.

Between the late colonial period and the Civil War, the countryside of the American northeast was largely transformed. Rural New England changed from a society of independent farmers relatively isolated from international markets into a capitalist economy closely linked to the national market, an economy in which much farming and manufacturing output was produced by wage labor. Using the Connecticut Valley as an example, The Roots of Rural Capitalism demonstrates how this important change came about. Christopher Clark joins the active debate on the "transition to capitalism" with a fresh interpretation that integrates the insights of previous studies with the results of his detailed research. Largely rejecting the assumption of recent scholars that economic change can be explained principally in terms of markets, he constructs a broader social history of the rural economy and traces the complex interactions of social structure, household strategies, gender relations, and cultural values that propelled the countryside from one economic system to another. Above all, he shows that people of rural Massachusetts were not passive victims of changes forced upon them, but actively created a new economic world as they tried to secure their livelihoods under changing demographic and economic circumstances. The emergence of rural capitalism, Clark maintains, was not the result of a single "transition"; rather, it was an accretion of new institutions and practices that occurred over two generations, and in two broad chronological phases. It is his singular contribution to demonstrate the coexistence of a family-based household economy (persisting well into the nineteenth century) and the market-oriented system of production and exchange that is generally held to have emerged full-blown by the eighteenth century. He is adept at describing the clash of values sustaining both economies, and the ways in which the rural household-based economy, through a process he calls "involution," ultimately gave way to a new order. His analysis of the distinctive role of rural women in this transition constitutes a strong new element in the study of gender as a factor in the economic, social, and cultural shifts of the period. Sophisticated in argument and engaging in presentation, this book will be recognized as a major contribution to the history of capitalism and society in nineteenth-century America.

Starting with the late 1800s, when her Norwegian great-grandfather immigrated to Dodge County, Trom Eayrs tracks the changes to farming over the years that ultimately gave rise to the disembodied corporate control of today's food system. Trom Eayrs argues that far from being an essential or inextricable part of American life, corporatism can and should be fought and curbed, not only for the sake of land, labor, and water but for democracy itself.  

Applying a feminist and environmentalist approach to her investigation of how the changing global economy affects rural women, Carolyn Sachs focuses on land ownership and use, cropping systems, and women's work with animals in highly industrialized as well as developing countries.Viewing rural women's daily lives in a variety of circumstances, Sachs analyzes the rich multiplicity of their experiences in terms of their gender, class, and race. With a new preface and a new epilogue co-written with Jorge Ramirez-Lopez, this updated edition of Fresh Fruit, Broken Bodies provides an intimate examination of the everyday lives, suffering, and resistance of Mexican migrants in our contemporary food system. Seth Holmes, an anthropologist and MD in the mold of Paul Farmer and Didier Fassin, shows how market forces, anti-immigrant sentiment, and racism undermine health and health care. Holmes was invited to trek with his companions clandestinely through the desert into Arizona and was jailed with them before they were deported. He lived with Indigenous families in the mountains of Oaxaca and in farm labor camps in the United States, planted and harvested corn, picked strawberries, and accompanied sick workers to clinics and hospitals. This "embodied anthropology" deepens our theoretical understanding of the ways in which social inequities come to be perceived as normal and natural in society and in health care. In a new epilogue, Holmes and Indigenous Oaxacan scholar Jorge Ramirez-Lopez provide a substantive update about the protagonists in the book, focusing on the ways in which they have been involved individually and collectively in movements for Indigenous immigrant rights, farmworker rights, and the right to health over the last decade.

 Most studies of lesbian and gay history focus on urban environments. Yet gender and sexual diversity were anything but rare in nonmetropolitan areas in the first half of the twentieth century. Just Queer Folks explores the seldom-discussed history of same-sex intimacy and gender nonconformity in rural and small-town America during a period when the now familiar concepts of heterosexuality and homosexuality were just beginning to take shape.  Eschewing the notion that identity is always the best measure of what can be known about gender and sexuality, Colin R. Johnson argues instead for a queer historicist approach. In so doing, he uncovers a startlingly unruly rural past in which small-town eccentrics, "mannish" farm women, and cross-dressing Civilian Conservation Corps enrollees were often just queer folks so far as their neighbors were concerned. Written with wit and verve, Just Queer Folks upsets a whole host of contemporary commonplaces, including the notion that queer history is always urban history.

The science is conclusive: to avoid irreversible climate collapse, the burning of all fossil fuels will have to end in the next decade. In this concise and highly readable intervention, Ashley Dawson sets out what is required to make this momentous shift: simply replacing coal-fired power plants with for-profit solar energy farms will only maintain the toxic illusion that it is possible to sustain relentlessly expanding energy consumption. We can no longer think of energy as a commodity. Instead we must see it as part of the global commons, a vital element in the great stock of air, water, plants, and cultural forms like language and art that are the inheritance of humanity as a whole. People's Power provides a persuasive critique of a market-led transition to renewable energy. It surveys the early development of the electric grid in the United States, telling the story of battles for public control over power during the Great Depression. This history frames accounts of contemporary campaigns, in both the United States and Europe, that eschew market fundamentalism and sclerotic state power in favor of energy that is green, democratically managed and equitably shared.

American agriculture employs some 2.5 million workers during a typical year, most for fewer than six months. Three fourths of these farm workers are immigrants, half are unauthorized, and most will leave seasonal farm work within a decade. What do these statistics mean for farmers, for laborers, for rural America? This book addresses the question by reviewing what is happening on farms and in the towns and cities where immigrant farm workers settle with their families. Philip Martin finds that the business-labor model that has evolved in rural America is neither desirable nor sustainable. He proposes regularizing U.S. farm workers and rationalizing the farm labor market, an approach that will help American farmers stay globally competitive while also improving conditions for farm workers.

Legal and environmental concerns related to Indian law and tribal lands remain an understudied branch of both indigenous law and environmental law. Native American tribes have a far more complex relationship with the environment than is captured by the stereotype of Indians as environmental stewards. Meaningful tribal sovereignty requires that non-Indians recognize the right of Indians to determine their own relationship to the land and the environment. But tribes do not exist in a vacuum: in fact they are deeply affected by off-reservation activities and, similarly, tribal choices often have effects on nearby communities. This book brings together diverse essays by leading Indian law scholars across the disciplines of indigenous and environmental law. The chapters reveal the difficulties encountered by Native American tribes in attempts to establish their own environmental standards within federal Indian law and environmental law structures. Gleaning new insights from a focus on tribal land and property law, the collection studies the practice of tribal sovereignty as experienced by Indians and non-Indians, with an emphasis on the development and regulatory challenges these tribes face in the wake of climate change. Between 2009 and 2019, West Virginian politicians aligned themselves with the interests of the coal industry to the substantial detriment of the citizens and economy of the state. Despite the undeniable low-carbon transformation that was occurring in the energy industry in the US during this period, state political leaders doubled down on coal. Rather than provide the leadership necessary to manage the transition of the state's economic drivers away from fossil fuels, they largely blamed the demise of the coal industry on the federal government. At every turn, the interests of the coal industry were placed above the economic and environmental health of West Virginians. James Van Nostrand tells the story of why West Virginia now faces overwhelming obstacles to competing in the economic marketplace of the twenty-first century. The book serves as a warning of how a fair energy transition can be derailed by political failure.

How prisons became economic development strategies for rural Appalachian communities As the United States began the project of mass incarceration, rural communities turned to building prisons as a strategy for economic development. More than 350 prisons have been built in the U.S. since 1980, with certain regions of the country accounting for large shares of this dramatic growth. Central Appalachia is one such region; there are eight prisons alone in Eastern Kentucky. If Kentucky were its own country, it would have the seventh highest incarceration rate in the world. In Coal, Cages, Crisis, Judah Schept takes a closer look at this stunning phenomenon, providing insight into prison growth, jail expansion and rising incarceration rates in America's hinterlands. Drawing on interviews, site visits, and archival research, Schept traces recent prison growth in the region to the rapid decline of its coal industry. He takes us inside this startling transformation occurring in the coalfields, where prisons are often built on top of old coalmines, including mountaintop removal sites, and built into community planning approaches to crises of unemployment, population loss, and declining revenues. By linking prison growth to other sites in this landscape--coal mines, coal waste, landfills, and incinerators--Schept shows that the prison boom has less to do with crime and punishment and much more with the overall extraction, depletion, and waste disposal processes that characterize dominant development strategies for the region. Schept argues that the future of this area now hangs in the balance, detailing recent efforts to oppose its carceral growth. Coal, Cages, Crisis offers invaluable insight into the complex dynamics of mass incarceration that continue to shape Appalachia and the broader United States.

Multidisciplinary and multi-genre, Y'all necessarily incorporates elements of critical theory, such as critical race theory and queer theory, while dealing with a multitude of methodologies, from quantitative analysis, to oral history and autoethnography. This collection eschews the contemporary trend of "reactive" or "responsive" writing in the genre of Appalachian studies, and alternatively, provides examples of how modern Appalachians are defining themselves on their own terms. As such, it also serves as a toolkit for other Appalachian readers to follow suit, and similarly challenge the labels, stereotypes and definitions often thrust upon them. While providing blunt commentary on the region's past and present, the book's soul is sustained by the resilience, ingenuity, and spirit exhibited by the authors; values which have historically characterized the Appalachian region and are continuing to define its culture to the present. This book demonstrates above all else that Appalachia and its people are filled with a vitality and passion for their region which will slowly but surely effect long-lasting and positive changes in the region. If historically Appalachia has been treated as a "mirror" of the country, this book breaks that trend by allowing modern Appalachians to examine their own reflections and to share their insights in an honest, unfiltered manner with the world.

Scholars who have studied rural people and places often have focused on a snapshot in time as they attempt to understand how human beings are impacted by change at the local community level. Community once was declared dead as a unit of analysis for social science scholars, yet the citizens who live in these places find that their attachments to place and to other people in these places are crucial to their lives. Too often those who study such phenomena fail to examine the longterm impacts of shocks to place and people. This methodological failing often leads to exaggerated estimations of the impacts of disasters on communities and their residents. Human beings and the social structures they create are resilient. In this book, the author fills some of the gaps in our knowledge when he returns repeatedly to Buffalo Creek for several years, long after the flash flood departed in 1972.
